San Jose police have arrested an athletic trainer from Archbishop Mitty High School on suspicion of sexually assaulting a 16-year-old female student and filming the incident. Kelvin Chiu, 31, was taken into custody after the alleged assault occurred on the evening of October 8 at the San Jose Catholic high school, authorities said Wednesday.

The student informed officers that Chiu had been providing care for a sports-related injury she had sustained on October 8. Following this, police said, he allegedly “sexually battered” her and recorded the incident on his phone. San Jose Police Department detectives arrested Chiu at his home in Fremont the day after the alleged assault. Officers subsequently searched his phone and located the reported footage, according to the police department.

Chiu was booked into Santa Clara County Main Jail. He faces charges on suspicion of annoying or molesting a minor, production and possession of child sexual abuse material, and sexual battery.

Archbishop Mitty High officials directed inquiries regarding the incident to the Diocese of San Jose, which oversees the school and other Catholic institutions in the South Bay. Cynthia Shaw, Director of Communications for the Diocese, stated that the school had not received any complaints about Chiu prior to the current allegations. Following the report, Chiu was immediately placed on administrative leave.

Shaw conveyed the Diocese's primary concern for the student, her family, and the wider school community. She also acknowledged the potential impact such a situation could have on students, confirming that the school’s counseling teams would be available to offer support to those who may need it. The Diocese encourages individuals to contact law enforcement as a first step for reporting improper conduct. However, reports can also be made directly to the Diocese's hotline at 844-372-1691 or through its website. Shaw added that the Diocese encourages any victim or survivor to come forward and report incidents of improper conduct, whether historical or current, occurring at any diocesan parish, school, or ministry.

San Jose police indicated that there may be additional victims related to the case. The department urged anyone with information pertaining to these allegations to contact them directly at 408-277-4102.
